ADC: Court Of Appeal Ruled The Appeal Was Incompetent, Still Asked For Status Quo Antebellum- Oshoma

In a recent interview shared by News Central, lawyer and political analyst Liborous Oshoma offered his perspective on the ongoing legal disputes surrounding party leadership and judicial decisions in Nigeria’s political space. He highlighted concerns about the procedural handling of cases at the appellate level and the implications for democratic processes.

According to Oshoma, the actions of the appellate court raised legal and practical questions, particularly in how it addressed the matter before it. He stated, “The court of appeal ruled the appeal was incompetent and still asked for status quo antebellum.” This, he explained, created confusion, as such an order typically assumes that the court has properly engaged with the substance of the case.

Oshoma noted that once a court declares an appeal incompetent, it ordinarily should not proceed to make further pronouncements that may influence the status of parties involved. He argued that issuing a status quo antebellum order in such circumstances could be seen as overreaching and potentially prejudicial to ongoing proceedings at the trial court level.
