According to Daily Post, a legal practitioner, Oba Maduabuchi, has emphasized that all court orders must be obeyed, irrespective of whether they are considered valid or invalid, as the political tension surrounding the attempted impeachment of Rivers State Governor, Siminalayi Fubara, continues.
Maduabuchi made the assertion while reacting to the actions of the Rivers State House of Assembly and the role of the state’s Chief Judge in the ongoing impeachment process. According to him, the legality or otherwise of a court order cannot be unilaterally determined by individuals or institutions affected by it but must be resolved through the appropriate judicial hierarchy.
He explained that once a court issues an order, compliance is mandatory until such an order is set aside by a higher court. He noted that disobedience to court directives, even where jurisdiction or procedural issues are questioned, undermines the rule of law and the stability of the legal system.
The lawyer clarified that the Chief Judge of Rivers State did not decline to act on the impeachment request but was constrained by existing court orders that restrained further steps. In his view, the Chief Judge’s position was a reflection of adherence to the law rather than a refusal to carry out constitutional duties.
Maduabuchi further pointed out that the House of Assembly had already approached a higher court by filing an appeal, which he described as the appropriate legal route. He stressed that it is only the appellate court that has the authority to determine whether the lower court orders were rightly or wrongly made.
He maintained that the controversy should be addressed strictly within the framework of the law, warning that any attempt to sidestep judicial processes could deepen the political crisis in the state. According to him, respect for court orders remains a cornerstone of democracy and constitutional governance.
