
According to Daily Post report on Monday, October 13, 2025, The Mazi Nnamdi Kanu Global Defence Consortium (KGDC) has declared that an eight-day “jurisdictional vacuum” following the Court of Appeal’s 2022 acquittal of the IPOB leader, Mazi Nnamdi Kanu, rendered his prosecution by the Nigerian government null and void.
In an advocacy brief dated October 12, 2025, co-chair Dr. Idawarifa C. Ebirien said the period between October 13 and 21, 2022—from Kanu’s discharge to the controversial stay of execution granted by a panel led by Justice Haruna Tsammani—created a legal void that “killed” the case.
Titled “Exposing the Jurisdictional Farce: The Eight-Day Death of Nnamdi Kanu’s Prosecution and the Corrupt Panel Stay That Defied Justice,” the statement described the government’s continued trial as “a zombie proceeding sustained by executive lawlessness.”
The consortium argued that once the Court of Appeal acquitted Kanu, his prosecution became “legally extinct,” and his continued detention by the DSS turned into “outright contempt.” It further faulted the October 21, 2022 stay of execution, calling it “void from inception” since criminal acquittals take immediate effect and cannot be suspended.
Citing several Supreme Court decisions, including A.G. Federation v. Abubakar (2007) and Onagoruwa v. State (1993), the group said no court has the power to stay a discharge or acquittal. The Tsammani panel’s decision, it added, “arrived eight days too late to revive what had already perished.”
The KGDC insisted that the repeal of the Terrorism (Prevention) Act 2011 in 2022 further invalidated the foundation of Kanu’s trial, describing ongoing proceedings as “a legal ghost kept alive by political fiat.”
Calling on the United Nations, African Union, and International Criminal Court to intervene, the consortium urged Kanu’s immediate release and investigation into alleged judicial corruption and rendition crimes.
“Mazi Nnamdi Kanu’s ordeal reflects the decay of Nigeria’s rule of law,” the statement concluded. “The eight-day vacuum ended the prosecution; the stay mocked it; and the repeal buried it beyond revival.” See, More, Here>>>>
