Kanu: The Court Cannot Lower Its Standard Of Proof For You Just Because You Have No Lawyer -Amadi

In a recent interview on Arise TV, legal scholar and political analyst Dr. Sam Amadi emphasized that the judiciary must uphold the same strict standard of justice in the ongoing trial of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), even though Kanu has chosen to represent himself.

Amadi, who is the Director of the Abuja School of Social and Political Thought, explained that while the Constitution grants every accused person the right to self-representation, it does not mean the court can compromise on the principles of justice. “The court cannot lower its standard of proof for you just because you have no lawyer,” he stated firmly, noting that criminal cases, particularly those involving treason, must still be proven beyond reasonable doubt.

He elaborated that the judge has a duty to ensure that Kanu is given every facility necessary for his defense, including access to case materials, witnesses, and sufficient time to prepare. However, Amadi stressed that these accommodations do not translate to leniency in the application of the law. “The responsibility of the court is to balance fairness with firmness. It must ensure the accused understands his rights and the weight of the charges against him,” he added.

Amadi also analyzed the political undercurrent surrounding the case, describing it as both a legal and political struggle. He said Kanu’s decision to represent himself might be a strategic move to draw attention to the broader political cause of IPOB. “This case goes beyond the courtroom. It’s also about perception, identity, and political resistance. Many revolutionaries have used their trials to send a political message,” he noted.

The discussion came amid a separate controversy involving ex-militant leader Government Ekpemupolo, popularly known as Tompolo, who recently denied issuing a 21-day ultimatum to the Federal Government over Kanu’s detention. In a statement signed by Dr. Paul Bebenimibo, media consultant to Tantita Security Services Nigeria Limited, Tompolo described the publication as “false and misleading,” urging Nigerians to disregard it.

Tompolo reaffirmed his loyalty to President Bola Tinubu, saying he has already endorsed the president for a second term and remains committed to supporting the administration’s Renewed Hope Agenda.

As the debate over Kanu’s self-representation continues, Amadi’s remarks highlight the delicate balance between law and politics in high-profile national cases. His assertion that “the court cannot lower its standard of proof for you just because you have no lawyer” serves as a stern reminder that the rule of law must remain the guiding principle, regardless of who stands in the dock.
