In a recent interview shared by News Central TV, legislative consultant and public policy analyst Chibuzo Okereke offered a detailed legal perspective on the impeachment notice issued against Rivers State Governor, Siminalayi Fubara, stressing the importance of constitutional procedure in such sensitive matters.
Speaking on the unfolding political developments in the state, Okereke cautioned lawmakers against bypassing laid-down constitutional steps, noting that impeachment-related actions must strictly comply with Section 188 of the 1999 Constitution as amended. According to him, any deviation from due process could expose the entire exercise to legal challenges and judicial reversal.
He emphasized that removal proceedings are not meant to be driven by emotions or political rivalry, but by clear constitutional requirements that protect democratic institutions. Okereke explained that the constitution provides a sequential process that must be followed from the very beginning to ensure legitimacy and fairness.
“You don’t start removal process with a motion you start with a petition alleging gross misconduct,” he stated, underscoring that the initiation stage is critical to the credibility of the entire process.
The public policy analyst further noted that failure to adhere to procedural rules weakens the authority of the legislature and undermines public confidence in governance. He added that courts are empowered to scrutinize impeachment processes where procedural breaches are evident, despite constitutional provisions limiting judicial interference after completion.
Okereke urged political actors in Rivers State to prioritize constitutionalism, institutional stability, and democratic norms over personal or partisan interests, warning that reckless actions could deepen political instability and stall governance in the state.
