According to a video posted on Fox News on Thursday, July 23, 2026, Secretary of State Marco Rubio criticized members of the International Criminal Court, arguing that some individuals within the organization are pursuing baseless cases against American troops and leaders.
Rubio made the comment while defending the administration’s stance that the ICC has no authority over the United States.
Rubio explained that the U.S. never signed the treaty that established the ICC and has never agreed to fall under its jurisdiction.
He said the court has nonetheless claimed a right to pursue non-member states, including efforts to detain heads of state and other officials, a position he said Washington has long disputed.
In his words, Rubio said, “We’re not members of the ICC. We never signed that treaty. We never joined it.
“And they somehow claim that they have a right nonetheless to go after non-treaty members and put heads of state and others in jail. We’ve long had quarrels with them.
“And we have lunatics and crazies involved in the ICC that are talking about charging members of the US military, maybe even the president or a future president with crimes and it’s not going to happen,” he said.
Rubio said the United States will not tolerate any attempt to apply ICC jurisdiction to Americans, now or in the future.
He said other nations are free to join the court if they wish, but Washington has warned the ICC repeatedly that it will not accept that authority, and he said the organization would now see the consequences of continuing to ignore that warning…See_More
